BY CREATING A BannerDroid ACCOUNT AND/OR USING THE SERVICES, YOU ARE CONSENTING TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, DO NOT USE OUR SERVICES.

Use of BannerDroid.com
BannerDroid.com provides an online digital products available for purchase, product descriptions, product images, product samples and other digital content. With the exception of any portion of the BannerDroid products, you may download, view, copy and print any other aspect of this site, (i) solely for personal, informational, and non-commercial purposes; and (ii) provided that neither the materials, nor any proprietary notices therein, are modified or altered.
You agree not to upload on or transmit to or via BannerDroid.com any content which: (i) infringes or otherwise violates any copyright, patent, trademark, trade secret or other proprietary right; (ii) is defamatory, libelous, expresses hate, or is unlawfully threatening; (iii) is pornographic, obscene or exploitative of a minor; (iv) contains or embodies a virus, worm, Trojan Horse or other contaminating or destructive feature; or (v) otherwise violates any applicable treaty, law or regulation.
You agree you will not interfere, in any way, with others' use of or access to BannerDroid.com and will not attempt to gain unauthorized access to the account or computer system of any other BannerDroid.com site user. You further agree not to take any other action in connection with your use of BannerDroid.com which violates any treaty, law or regulation and to fully comply with all applicable treaties, laws and regulations in your use of BannerDroid.com. BannerDroid.com assumes no liability, and shall not be held responsible for, any action you take in connection with your use of BannerDroid.com.

User Content
Except where otherwise expressly provided by BannerDroid.com, all comments, feedback, or information submitted to BannerDroid.com through or in association with BannerDroid.com (collectively, "User Content") will be considered non-confidential and BannerDroid.com property. By submitting such User Content to BannerDroid.com, you agree that you assign to BannerDroid.com, without charge, all worldwide rights, title and interest, including copyrights and other intellectual property rights, in and to the User Content. BannerDroid.com will be free to use such User Content in any manner or media whatsoever, on an unrestricted basis and without any compensation or royalties to you.
You also represent and warrant that you own or otherwise control all of the rights to the User Content that you post; that the User Content is accurate; and that use of the User Content you supply does not violate this policy and will not cause injury to any person or entity. BannerDroid.com has the right but not the obligation to monitor and edit or remove User Content. BannerDroid.com takes no responsibility and assumes no liability for any User Content posted by you or any third party.

Deliverables
All widgets, js codes, flash files/swf, data files, images and other final published files/deliverables are owned by you (the end-user) AS IS, meaning that after receiving/getting the code from our Services (e.g. published banners/slidehsows page) the end user is not allowed to change or modify anything inside the deliverable. He can use it only as it is provided by the Services. Exceptions can be made for html/js code that can be edited to comply with your site, but we do not support this action.

Warranty and Disclaimer
THIS SOFTWARE IS PROVIDED BY THE AUTHOR "AS IS" AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL THE AUTHOR BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

Termination
You agree that BannerDroid.com, in its sole discretion, may terminate your account or your use of the Service and remove and discard any Content within the Service, for any reason or no reason. Any suspected fraudulent, abusive or illegal activity that may be grounds for termination of your use of the Service may be referred to appropriate law enforcement authorities. You agree that any termination of your access to the Service may be effected without prior notice, and you acknowledge and agree that BannerDroid.com may immediately deactivate or delete your account and all related Content in your account and/or bar any further access to such Content. Further, you agree that BannerDroid.com shall not be liable to you or any third party for any termination of your access to the Service or deletion of such Content.
